In the New York Times of March 20, we were most interested in a provocative article titled, “In a New Aisle, Energy Drinks Sidestep Some Rules”. As food labeling practitioners, we are most accustomed to thinking that the movement of manufacturers from FDA regulated food products to the much more loosely regulated Dietary Supplement sector is a “one-way street”.

This article highlights a manufacturer who has reversed the paradigm by which we view such matters. Our readers know that we will not comment beyond noting that we think that any Regulatory Science professional who has worked with DSHEA will find this article fascinating.
